Terms of Service – Construction Weather

Please read these Terms of Service carefully before using Construction-Weather.com ("the platform", "the service"). By accessing or using the service, you agree to be bound by these terms. If you do not agree, do not use the service.

1. About the service

Construction-Weather.com provides weather data, analysis tools and AI-assisted document drafting for use by construction industry professionals. The service includes trade-level forecasting, historical weather data retrieval, EOT evidence review, early warning notice drafting and tender planning tools.

2. Eligibility and accounts

You must be at least 18 years old and acting in a professional or business capacity to use the platform. By creating an account you represent that the information you provide is accurate and that you have authority to accept these terms on behalf of any organisation you represent.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

3. Acceptable use

You agree to use the service only for lawful purposes and in accordance with these terms. You must not:

Use the service in any way that violates applicable laws or regulations
Attempt to gain unauthorised access to any part of the platform or its underlying systems
Scrape, crawl or systematically extract data from the platform by automated means
Resell or redistribute the service or its outputs without our written permission
Use the service to generate content intended to mislead or defraud third parties
Interfere with the security, availability or performance of the platform

4. AI-generated content and professional responsibility

Some features of the platform use artificial intelligence to generate draft documents, including Early Warning Notices. These outputs are provided for review and editing purposes only. They do not constitute legal advice, contractual notices or formal claims.

You are solely responsible for reviewing, amending and deciding whether to issue any document generated by the platform. We strongly recommend obtaining qualified legal or contractual advice before issuing formal notices or claims based on platform outputs.

5. Weather data accuracy

Weather data on the platform is sourced from third-party providers including Open-Meteo. While we take reasonable steps to present accurate data, weather information is inherently uncertain and historical records may contain gaps or errors. We do not warrant that any data, forecast or analysis provided through the platform is accurate, complete or suitable for any particular purpose.

Decisions based on platform data — including commercial, contractual or safety decisions — are made at your own risk.

6. Subscription and billing

During the open beta period the platform is free to use. When paid plans are introduced, the applicable pricing will be displayed on the pricing page. Subscriptions are billed through Stripe. Cancellations take effect at the end of the current billing period. We reserve the right to change pricing with reasonable advance notice to subscribers.

7. Intellectual property

All software, design, content and trademarks associated with Construction-Weather.com are owned by us or licensed to us. You may not copy, modify, distribute or create derivative works from platform content without our prior written consent.

Data you input into the platform (project names, locations, contract details) remains yours. By using the service you grant us a limited licence to process that data to operate the service.

8. Limitation of liability

To the maximum extent permitted by law, Construction-Weather.com and its operators shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the platform, including but not limited to loss of profit, loss of data, or costs arising from reliance on platform outputs in contractual disputes.

Our total liability to you for any claim arising from use of the platform shall not exceed the amount you paid to us in the twelve months preceding the claim.

9. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement. We do not guarantee uninterrupted or error-free operation of the platform.

10. Termination

We may suspend or terminate your access to the platform if you breach these terms, or for any other reason at our discretion with reasonable notice. You may stop using the platform at any time. On termination, provisions that by their nature should survive (including intellectual property, limitation of liability and disclaimers) will continue to apply.

11. Changes to these terms

We may update these terms from time to time. We will notify you of material changes via the platform or by email. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.

12. Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
